We automatically collect and process information relating to the customer, subscription, and use of the services in accordance with this privacy and information security statement when the customer orders and uses the Feelment service.

We regularly review the up-to-dateness of our data protection and information security principles and update this written statement as our operations and the Feelment service develop. We encourage customers to regularly check our latest privacy and information security practices.

This statement describes the key data protection and information security principles and practices that we follow to protect our customers’ privacy and the confidentiality of communications. This statement applies to all processing of company data and personal data related to our services.

Legal basis

When you purchase a service from us, we enter into an agreement with you. In order to provide the agreed service, handle related invoicing, accounts receivable and payment control, and deliver the content ordered by the customer, we process not only company data but also necessary personal data, such as invoicing-related information and information about the location and place of use of the service.

The processing of personal data and company data is based on the agreement between the customer and Viihdeväylä Oy, information received in connection with the use of the service or registration, or consent given by the customer.

What data do we collect?

We mainly provide our services to corporate customers and entrepreneurs. When entering into business-to-business agreements, we collect and process different types of company data and personal data. Company data refers to information that can be used to identify a company or entrepreneur. Personal data refers to information from which an individual can be identified. These individuals and the information relating to them are always connected to Viihdeväylä Oy’s customers or customer relationships.

Primary data collected and processed

The company data and personal data listed below may be obtained from the company and the customer themselves, for example when registering for the service, as well as from public sources. The data is always processed in accordance with data protection principles. The following customer data collected from customers essentially forms Viihdeväylä Oy’s customer register, in which the data is recorded. The primary data collected and processed includes:

1) Customer’s basic information: name of the company or entrepreneur, business ID, company’s responsible persons or entrepreneur including personal identity code;

2) Customer’s contact information: postal address, email address, phone number, detailed invoicing information;

3) Information about the main users representing the customer and other contact persons: first name, last name, phone number, email address, title/role in the company;

4) Communication between Viihdeväylä and the customer regarding orders, confirmations and payments;

5) IP address and operating system of the device used by the customer;

6) Information related to customer relationship management, including invoicing, payment of subscription fees and debt collection;

7) Type and duration of the customer’s subscription and access rights;

8) System log events relating to the use of the services and the customer-specific user account.

What do we use the data for?

We primarily process data relating to the customer and services for the purpose of managing the customer relationship. We collect and process different types of company data and personal data in order to provide, maintain and market our services, or to carry out other cooperation.

We process your data when it is necessary for the purposes of our legitimate interests. In such cases, we process necessary data to ensure, maintain, improve and compile statistics on the functionality of our services, as well as to develop our business. In addition, we may provide you with information about our services that may be of interest to you within the scope of our legitimate interests.

We are also obliged to report to the rights holders of the content used in the Feelment service or their representatives: customer-specific revenue, content used in the services, amount of usage, and, where necessary, such information by place of use and customer. In connection with this usage reporting, for example the customer’s business ID or personal identity code may be reported in order to identify the place of use or the customer.

Sources of data

Company data and personal data are collected from the company and the customer themselves, for example in connection with registration for the service, as well as from public sources. Technical data concerning the IP address, operating system and log events of the device used by the customer is collected when the service is used. Although technical data generally cannot be used to identify individuals, we process both company data and technical data as personal data.

Cookies

We use cookies and similar technologies on our website to collect information about users of our site. Cookies help us ensure the functionality of our website, serve our users better, provide targeted advertising and develop our services. Some cookies, tracking technologies and scripts are necessary for the technical operation and use of our website.

Processing of data outside Europe

Personal data relating to our services is stored within the EU and EEA. However, some of the service providers we use, such as Google and HubSpot, operate internationally, which means that company data and personal data may in some situations be processed or transferred outside the EU and EEA.

Such processing may be necessary, for example, for the technical provision, maintenance, security, analytics or legal obligations related to the services. We ensure that appropriate safeguards are used in the processing of data, such as standard contractual clauses approved by the EU or other safeguards in accordance with applicable data protection legislation.

Disclosure of data

We may disclose data to third parties or authorities within the limits permitted and required by applicable law, and also on the basis of what has been agreed in the terms of use agreed and approved between Viihdeväylä Oy and the customer, where this provides a contractual basis for the disclosure of data.

Company data, personal data and other information relating to the service and customer relationship may also be disclosed to third parties in connection with a possible acquisition, merger, outsourcing, business transaction or transfer of business operations.

Infromation security

Data is stored and processed on servers and in services located within the EU and EEA. We ensure the information security of the Feelment service by applying various technical procedures that are appropriate in relation to the severity of threats, the level of technical development and costs.

Administrative connections to servers, as well as the transfer of customer data in connection with purchase transactions and invoicing material, are carried out using secure connections.

Our registers and server operations are appropriately protected in accordance with industry standards and various technical protection systems. We may use external service providers to procure technical solutions and services for the processing of stored data.

Unfortunately, no information security system can be guaranteed to be completely secure or error-free. For this reason, the customer must also take appropriate measures to ensure their own information security.

Data breaches

To prevent data breaches and eliminate disruptions affecting information security, we take immediate action, including removing viruses and other malware and carrying out other comparable necessary technical measures within the limits permitted and required by law. In such cases, for example, the sending or receiving of infected messages between Viihdeväylä Oy and the customer may be prevented. We will always notify the customer without delay if data breaches or, for example, viruses/malware are detected in the provision of the customer-specific service or in connection with it.

Data retention

We retain customer data in accordance with applicable legislation, such as legislation concerning accounting and taxation, and otherwise only for as long as necessary to fulfil the purposes described in this statement. However, customer data may also be retained for three (3) years after the end of the customer relationship.

Rights of access and information rights

The data subject has the right to:

1) Check what data concerning them has been stored in the customer register and receive a copy of it.

2) Request that the controller rectify inaccurate company data or personal data concerning the data subject and complete incomplete company data or personal data.

3) Request that the controller erase outdated data concerning the data subject. In addition, the data subject has the right to have data concerning them erased from the systems if the data subject withdraws the consent on which the processing was based and there is no other lawful basis for the processing.

4) Request restriction of processing, object to the processing of data, or exercise the right to transfer data from one system to another.

To exercise the rights referred to above, the data subject must contact the person responsible for the register in writing. The identity of the person making the request may be verified before the request is fulfilled, if necessary. If you believe that your personal data is being processed unlawfully, you have the right to lodge a complaint with a supervisory authority.

Updating data

When you interact with us, we ask you to provide your company data or personal data. If your information has changed, we ask you to update the changed information with us. If you notice an error in your own data, you can correct it by notifying us and contacting customer service.
